Should people suffering from untreatable psychiatric conditions be eligible for physician-assisted death? This is possible in Belgium and the Netherlands, where PAD for psychiatric conditions is permitted, though rare, so long as the criteria of due care are met. Those opposed to all instances of PAD point to Belgium and the Netherlands as a dark warning that once PAD is legalized, restricting it will prove impossible because safeguards, such as the requirement that a patient be terminally ill, will inevitably (...) be eroded or discarded. However, some supporters respond that limiting PAD to those suffering from terminal illness, or physical illnesses generally, is arbitrary and illogical. In addition, precisely because such patients are not terminally ill, their suffering may last for years, even the rest of their lives. Finally, severe depression may not be treatable. If PAD is justifiable under some conditions—as I shall assume in this article—then why wouldn't it be justifiable for these patients? How? In February 1970 I was given a copy of Hesse’s novel Siddhartha, a fictionalized account of the Buddha’s life. Already an active Christian, it was this gift, received my senior year in high school, that introduced me to Buddhism and to the reality of spiritual journey and the possibility of enlightenment. While I know the Buddhist meaning of that term, it serves for Christians as well, because our God could not leave us in darkness but made light the first creature (Gen. 1:1–5) and came among us as light (John 1:1–5). 1 When in the fall of 1970 my brother traveled to Japan, the memento I requested was a small statue of the Buddha. It is beside me as I write. In 1983 when we moved to Germany, the second book I bought in German was Siddhartha; the first was the New Testament.Over the years I have had the opportunity to continue to study the life of the Buddha and the spread and development of his teachings. In summary, the creation and maintenance of the Wistar Rats as standardized animals can be attributed to the breeding work of Helen Dean King, coupled with the management and husbandry methods of Milton Greenman and Louise Duhring, and with supporting documentation provided by Henry Donaldson. The widespread use of the Wistar Rats, however, is a function of the ingenuity of Milton Greenman who saw in them a way for a small institution to provide service to science. Greenman's rhetoric, as captured (...) in his Director's Reports, prepared annually from 1905 until his death in 1937, shows that he was unusually sensitive to his times and to the economics of science and of society. In the era when biology was being defined, he recognized in the rat the potential to be a living analog to the pure chemicals that legitimated experimental science. From management literature he extracted the ideals of uniformity of product, standards of quality, and efficiency of production, applying them to scientific practice to generate an animal model that thrives as standard equipment in laboratories throughout the world today.I will close with a quote from Frederick W. Taylor that is a cogent statement of the contribution to science and scientific progress made by standardized tools and their creators. Equating the surgeon and the workman, Taylor wrote: [He is given] the finest implements, each one of which has been the subject of special study and development ... [and] the very best knowledge of his predecessors; and, provided with standard implements and methods which represent the best knowledge of the world up to date, he is able to use his own originality and ingenuity to make real additions to the world's knowledge, instead of reinventing things which are old.Standardized tools, whether surgeons' implements or laboratory-bred rats, are one of the vehicles for carrying scientific knowledge forward from generation to generation. This paper examines how innovative skills and knowledge are transmitted and acquired among adolescents in two hunter-gatherer communities, the Aka of southern Central African Republic and the Chabu of southwestern Ethiopia. Modes of transmission and processes of social learning are addressed. Innovation as well as social learning have been hypothesized to be key features of human cumulative culture, enhancing the fitness and survival of individuals in diverse environments. The innovation literature indicates adult males are more innovative than children and female (...) adults and therefore predicts that adolescents will seek out adult males. Further, the mode of transmission should be oblique. Thus, learning of innovations should be oblique or horizontal rather than vertical, with adolescents paying particular attention to “successful” innovative individuals. The social learning literature indicates that complex skills or knowledge is likely to be learned through teaching, and therefore that teaching will be an important process in the transmission of innovations. In-depth and semi-structured interviews, informal observations, and systematic free-listing were used to evaluate these hypotheses. The study found that cultural context patterned whether or not adolescents sought out adult male or female innovators; oblique modes of transmission were mentioned with greater frequency than horizontal or vertical modes; knowledge and skill bias was notable and explicitly linked by the adolescents to reproductive effort; and teaching was biased toward same-sex individuals and was an important but not an exclusive means of transmitting complex skills and social knowledge. In light of the recent emergence of predictive techniques in law enforcement to forecast crimes before they occur, this paper examines the temporal operation of power exercised by predictive policing algorithms. I argue that predictive policing exercises power through a paranoid style that constitutes a form of temporal governmentality. Temporality is especially pertinent to understanding what is ethically at stake in predictive policing as it is continuous with a historical racialized practice of organizing, managing, controlling, and stealing time. After first (...) clarifying the concept of temporal governmentality, I apply this lens to Chicago Police Department’s Strategic Subject List. This predictive algorithm operates, I argue, through a paranoid logic that aims to preempt future possibilities of crime on the basis of a criminal past codified in historical crime data. (shrink)

This research ethics article focuses on an unexpected finding from my Master’s thesis examining bereaved participants’ experiences of taking part in sensitive qualitative research: some participants wanted their real names used in my written dissertation and any subsequent empirical publications. While conducting interviews for my thesis and explaining the consent process, early responses highlighted the problematic notion of anonymity for participants engaged in qualitative research. Several participants asserted the significance of immortalizing their deceased loved ones in the pages of my (...) thesis, retaining ownership over their words and maintaining a public attachment to their personal identity. The preliminary responses also resonate with concerns regarding the ethics of assigning pseudonyms and anonymity to participants in qualitative research. Themes in the extant literature tend to centre on issues of researchers’ accountability and transparency towards participants or respect. The present article contributes to the debates surrounding anonymity and confidentiality within qualitative research, and also expands on specific issues pertaining to bereavement research ethics. And in this context arise questions about the extent to which individuals with disabilities may decline treatments to ameliorate disabling conditions. We argue in this article that many common adverbial phrases generally taken to signal a discourse relation between syntactically connected units within discourse structure instead work anaphor- ically to contribute relational meaning, with only indirect dependence on discourse structure. This allows a simpler discourse structure to provide scaffolding for compositional semantics and reveals multiple ways in which the relational meaning conveyed by adverbial connectives can interact with that associated with discourse structure. We conclude by sketching out a lexicalized grammar for (...) discourse that facilitates discourse interpretation as a product of compositional rules, anaphor resolution, and inference. (shrink)

Sophocles' Antigone is a touchstone in democratic, feminist and legal theory, and possibly the most commented upon play in the history of philosophy and political theory. Bonnie Honig's rereading of it therefore involves intervening in a host of literatures and unsettling many of their governing assumptions. Exploring the power of Antigone in a variety of political, cultural, and theoretical settings, Honig identifies the 'Antigone-effect' - which moves those who enlist Antigone for their politics from activism into lamentation. She argues (...) that Antigone's own lamentations can be seen not just as signs of dissidence but rather as markers of a rival world view with its own sovereignty and vitality. Honig argues that the play does not offer simply a model for resistance politics or 'equal dignity in death', but a more positive politics of counter-sovereignty and solidarity which emphasizes equality in life. Through examining practices of torture, extra-judicial assassination, and first person accounts of soldiers on the ground, Bonnie Mann develops a new theory of gender.

Background:The perceptions of core professional nursing values of men in baccalaureate nursing programs are poorly understood.Objective:The study purpose was to understand and interpret the meaning of core professional nursing values to male baccalaureate nursing students.Research design and context:One-to-one interviews were conducted with male nursing students from a public university in the Midwest, following interpretive phenomenology.Ethical considerations:Measures to protect participants included obtaining Institutional Review Board approval, obtaining signed informed consent, and maintaining confidentiality.Findings:The study revealed five themes and several subthemes under an (...) overarching finding of caring. Acquisition of professional nursing values began prior to the nursing program and continued to varying degrees throughout the program.Discussion:Several implications are offered for nursing education, nursing practice, research, and public policy. These include identification of common values, teaching-learning strategies, inclusive environments, teamwork, and conflict resolution.Conclusion:Caring was revealed using a metaphor of a puzzle. Curiously, two central areas are unaddressed by Epstein et al.: (i) L1A–L2A differences; (ii) L2 development. Here, findings relevant to (i) and (ii) – as well as their significance – are discussed. Together these form the basis for contesting Epstein et al.'s “Full Access” approach, but nonetheless analyses of the L2 data argue for UG-constrained L2A. Also discussed is the inadequacy of accounts (like Epstein et al.'s) without an explicit and prominent role for the L1.

This article argues that the meaning of the word ‘autism’ experienced a radical shift in the early 1960s in Britain which was contemporaneous with a growth in epidemiological and statistical studies in child psychiatry. The first part of the article explores how ‘autism’ was used as a category to describe hallucinations and unconscious fantasy life in infants through the work of significant child psychologists and psychoanalysts such as Jean Piaget, Lauretta Bender, Leo Kanner and Elwyn James Anthony. Theories of autism (...) were then associated both with schizophrenia in adults and with psychoanalytic styles of reasoning. The closure of institutions for ‘mental defectives’ and the growth in speech therapy services in the 1960s and 1970s encouraged new models for understanding autism in infants and children. The second half of the article explores how researchers such as Victor Lotter and Michael Rutter used the category of autism to reconceptualize psychological development in infants and children via epidemiological studies. These historical changes have influenced the form and function of later research into autism and related conditions. (shrink)

Every year, hundreds of patients in England die whilst waiting for a kidney transplant, and this is evidence that the current system of altruistic-based donation is not sufficient to address the shortage of kidneys available for transplant. To address this problem, we propose a monopsony system whereby kidney donors can opt-in to receive financial compensation, whilst still preserving the right of individuals to donate without receiving any compensation. A monopsony system describes a market structure where there is only one ‘buyer’—in (...) this case the National Health Service. By doing so, several hundred lives could be saved each year in England, wait times for a kidney transplant could be significantly reduced, and it would lessen the burden on dialysis services. Furthermore, compensation would help alleviate the common disincentives to living kidney donation, such as its potential associated health and psychological costs, and it would also help to increase awareness of living kidney donation. The proposed system would also result in significant cost savings that could then be redirected towards preventing kidney disease and reducing health disparities. While concerns about exploitation, coercion, and the ‘crowding out’ of altruistic donors exist, we believe that careful implementation can mitigate these issues. Therefore, we recommend piloting financial compensation for living kidney donors at a transplant centre in England. (shrink)

Involvement of industry in academic research is widespread and associated with favorable outcomes for industry. The objective of this study was to review empirical data on the attitudes of researchers toward industry involvement and financial ties in research. A review of the literature for quantitative data from surveys on the attitudes of researchers to financial ties in research, reported in English, resulted in the 17 studies included. Review of these studies revealed that investigators are concerned about the impact of financial (...) ties on choice of research topic, research conduct and publication, but this concern is less among investigators already involved with industry. Researchers approve of industry collaboration and financial ties when the ties are indirectly related to the research, disclosure is upfront, and results and ideas are freely publicized. However, their trust in disclosure as a way to manage conflicts may reveal a lack of awareness of the actual impact of financial incentives on themselves and other researchers. (shrink)

Hospital ethics committees are common, but not universal, in small hospitals. A needs assessment was completed at a 155-bed community hospital in order to adapt an academic tertiary center model for a clinical ethics committee to fit the needs of the small hospital community. Of 678 questionnaires distributed, 209 were completed. Data suggested that clinical staff frequently experienced ethical dilemmas. Significantly more nonphysicians indicated that they would utilize a consultation service, if available, compared to physicians (p = 0.0067). The data (...) also indicated that the majority of staff (>80 percent) desired more education in clinical ethics. Physicians preferred annual or bi-annual hospital-wide grand rounds, compared to nonphysicians, who preferred more frequent department-based teaching (p < 0.001). The data presented in this article were used to subsequently develop a clinical ethics support committee, the process of which is also described. (shrink)

Following the conquest of Algiers and its surrounding territory by the French army in 1830, officers noted an abundance of standing stones in this region of North Africa. Although they attracted considerably less attention among their cohort than more familiar Roman monuments such as triumphal arches and bridges, these prehistoric remains were similar to formations found in Brittany and other parts of France. The first effort to document these remains occurred in 1863, when Laurent-Charles Féraud, a French army interpreter, recorded (...) thousands of dolmens and stone formations south-west of Constantine. Alleging that these constructions were Gallic, Féraud hypothesized the close affinity of the French, who claimed descent from the ancient Gauls, with the early inhabitants of North Africa. After Féraud's claims met with scepticism among many prehistorians, French scholars argued that these remains were constructed by the ancestors of the Berbers, whom they hypothesized had been dominated by a blond race of European origin. Using craniometric statistics of human remains found in the vicinity of the standing stones to propose a genealogy of the Kabyles, French administrators in Algeria thereafter suggested that their mixed origins allowed them to adapt more easily than the Arab population to French colonial governance. This case study at the intersection of prehistoric archaeology, ancient history and craniology exposes how genealogical classification made signal contributions to French colonial ideology and policy between the 1860s and 1880s. This research merges literature from organizational behavior and marketing to garner insight into how organizations can maximize the benefits of Corporate Social Responsibility for enhanced CSR and organizational engagement of employees. Across two field experiments, the authors demonstrate that the effectiveness of employee co-creation activities in increasing employees’ positive CSR perceptions is moderated by self-construal. In particular, the positive effect of co-creation on CSR perceptions emerges only for employees with a salient interdependent self-construal. Moreover, the results demonstrate that increased positive (...) CSR perceptions then predict increased CSR engagement and organizational engagement. The research thus highlights the need to consider self-construal when trying to utilize co-creation to predict CSR engagement and organizational engagement, via CSR perceptions. (shrink)

Feminist Interpretations of Hannah Arendt, edited by Bonnie Honig, a collection of critical feminist essays on Hannah Arendt, illustrates both the disorientation and the insights that can result when feminist philosophers come to terms with a canonical figure who is a woman.

This article explores the status of a UN mandate for military intervention, especially in the aftermath of the non-mandated interventions in Kosovo and Iraq. It examines the realist and positivist approaches to this issue, and proposes a third approach, called the ?human rights model? in which public legitimacy plays a key role. It shows that not only political assessments but also legal ones differ on this question according the premises they are based on. The article further analyses how normative and (...) military power interacts in today's global public debate, and concludes that legitimacy for an intervention is established on a case-by-case basis. This paper begins with a question: can concepts generated in the Chinese context in the sociocultural relations of the periphery contribute to the development of the social sciences in the field of Health and Physical Education (HPE) that have their roots in the metropole? Setting the scene in the Hong Kong Special Administrative Region (HKSAR), a postcolonial city reverted to the rule of the People’s Republic of China (PRC) in 1997, this paper aims to develop a critical sociology of HPE (...) by having a dialogue among Continental philosophies (e.g., Bourdieu) and Chinese philosophies around embodiment concepts. Although HKSAR is a complex meeting point of Eastern and Western ideologies, the current HPE field tends to focus on Western and ‘scientific’ ways of knowing, such as the measurement of health and physical fitness, and often at the expense of sociocultural perspectives, social justice and diversity and inclusion in HPE. In other words, the (post) positivistic research paradigm underpins the HPE field. This paper argues that in order to reap the benefits of a more holistic health education for academics and students in HPE, it is vital to de-imperialise the positivistic ways of teaching and being in HPE. In doing so, this paper creates a space for Bourdieu’s habitus to meet Chinese perspectives on embodiment to engage in a dialogue for knowledge production that extends the current knowledge base in HPE. Most of us believe that we are entitled to treat members of other species in ways which would be considered wrong if inflicted on members of our own species. We kill them for food, keep them confined, use them in painful experiments. The moral philosopher has to ask what relevant difference justifies this difference in treatment. A look at this question will lead us to re-examine the distinctions which we have assumed make a moral difference.

This essay is written in two parts. The first is a commentary on the affective politics of philosophy as a discipline. The theme here is philosophy’s reverence problem, an affective bond to the teacher and the text, which is threatened or even injured by feminist philosophy. Feminist philosophy emerges as disruptive irreverence in the midst of the discipline, and injured reverence becomes a powerful prereflective motivation for resistance to feminist thought. The second part of the essay is an exploration of (...) the field of inquiry called feminist phenomenology. Is feminist phenomenology simply phenomenology from another point of view, that of the embodied female subject? Is it conducted, in other words, in a space beyond politics and power where the difference of this subject discloses values and meanings that have not yet been thematized in phenomenological inquiry, but which phenomenology is already competent to pursue? Or does feminist phenomenology disrupt or transform phenomenological practice as we traditionally understand it? In this paper, I claim that phenomenology must be critical in order to be feminist, that it must disrupt phenomenological practice rather than simply “applying” it to a new object, “woman.” In the work of Simone de Beauvoir we find a different phenomenological practice that feminists can count as a positive inheritance. The real difference of feminist phenomenology, however, only emerges in the practice itself. In order to capture something about this difference I take the phenomenon of shame as a case study, and compare three recent phenomenological accounts of shame. (shrink)

continent. 2.2 (2012): 64–65 Notes on Notes on Sound, July 18, 8:34pm Isaac Linder Paul de Man begins his landmark text, Allegories of Reading , with a cheeky epigraph from the philosopher Blaise Pascal. It reads, 'Quand on lit trop vite ou trop doucement on n’entend rien' (When you read too quickly or too slowly you hear nothing). The epigraph is cheeky because in the course of de Man's work he avoids elucidating at what speed one would one would be (...) able to properly hear the texts to which they are attending. For de Man the force of literary tropes—the way they seduce and structure their multiple readings—relies on the intimate proximity of figures and properties in the relational linkages of a text. Textual spatialization trumps and belies the importance of the tempo and temporality. Enter the "site"-specific text videos by the Korean-American writer and improvising musician, Bonnie Jones. In these works, unique to the venues that have solicited them, the time of writing is captured and stored in a complex digital apparatus in the first instance, along with all of the hesitations, repetitions, and sudden keystrokes attending its production. Speed is pro-scribed— written in advance—and the time (five minutes and sixteen seconds) of Notes on Sound is spatialized into an affective mesh that ensnares the viewer in a doppler effect created between the speed of writing and the speed of reading. We're caught in the tempo of Jones' decisions (that is, unless we fast forward, pause, or rewind the text; unless it freezes or takes too long to load). We find ourselves subvocalizing along to a deceptively simple prompt ("please now together count back from one hundred") as the phonetic units that comprise the video permute into polyphony and warp like the minimalist pixelations of a concrete poem into the grammar of the Notes (that is, unless we are reading along out loud). We are forced to feel our form of reading as it unfolds, in a manner arguably more proliferate and protocolized than would have been known in Pascal's time. Would he have been able to hear anything? With its understated use of syntax and short-circuiting Notes on Sound is without a soundtrack, but by no means silent: Meditation on counting, on the sound of counting, and what counts as sounding; on the way we count on sound as a pre-text for things to ring true, as they do in the famously less calculable arenas of, say, emotion and poetry. Philosophers and intellectual historians generally recognize pragmatism as a philosophy of progress. For many commentators, pragmatism is tied to a notion of progress through its embrace of meliorism – a forward-looking philosophy that places hope in the future as a site of possibility and improvement. I complicate the progressive image of hope generally attributed to pragmatism by outlining an alternative account of meliorism in the work of William James. By focusing on the affectivity and temporality of James’s meliorism, I argue (...) that James offers a non-progressivist version of hope that is affectively tempered by melancholy and oriented temporally toward the present. Aid‐in‐dying laws in the United States have two important restrictions. First, only patients who are terminally ill, defined as having a prognosis of six months or less to live, qualify. Second, at the time the patients take the lethal medication, they must be competent to make medical decisions. This means that an advance directive requesting aid in dying for a later time when the patient lacks decision‐making capacity would be invalid. However, many people are more concerned about avoiding living into (...) severe dementia for years—a time when they will lack decision‐making capacity—than they are about preventing suffering or the loss of dignity or autonomy for a few months at the end of life.Gillian Bennett is an example of someone determined not to live into severe dementia. She opted for preemptive suicide in 2014, explaining why in a letter she posted online: “Every day I lose bits of myself, and it’s obvious that I am heading toward the state that all dementia patients eventually get to: not knowing who I am and requiring full‐time care.”A major problem with Bennett’s solution, however, is that the individual is likely thereby to be giving up some “good time.” A legal alternative to preemptive suicide is to create an advance directive stating the circumstances under which one wants not to receive any lifesaving or life‐sustaining treatment, even the most basic and noninvasive. This option is our focus in this paper: how to create effective advance directives to avoid living into severe dementia. To be relevant to progressive dementia, the directive would need to state what kinds of care should be withheld and when. At the same time, advance directives for severe dementia face serious challenges. Before addressing these, we review the normative force of directives themselves. (shrink)
